FACTS:
Following the running of Race 8, Tom Gundry Freight Handicap Pace, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against ARJUNA (D J Dunn), placed 3rd by the judge, by MISS MOET (A M Butt), which was pulled up, on the grounds of interference with 1050 metres to run.
Mr D J Dunn had endorsed and signed on the information form “I do not contest the relegation of ARJUNA to behind MISS MOET”.
Rule 869 provides as follows:
(8) The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses-
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.
SUBMISSION(S):
Mr Escott showed a video replay of the incident just prior to the 1000 metres. He pointed out ARJUNA, racing 3-wide and improving, with Mr Dunn attempting to keep the horse off MISS MOET, which was racing outside the leader at that point. ARJUNA shifted in and caused interference to MISS MOET which broke and was subsequently retired from the race. A number of trailing runners also suffered interference when MISS MOET broke.
Mr Escott sought disqualification of ARJUNA.
REASON(S):
The Committee was clearly satisfied that ARJUNA had interfered with the progress or chance of MISS MOET (and a number of other runners) in the incident shown to it with approximately 1050 metres to run. The Committee also noted that Mr Dunn, the driver of ARJUNA, did not contest the protest. It was appropriate to disqualify ARJUNA pursuant to Rule 1003 (2) (a).
DECISION:
The protest was upheld and ARJUNA was disqualified from the race. Consequent upon the disqualification, the amended placings for the Race are as follows;
