CHARGES:
Following race 2 an Information was filed pursuant to Rule 638(1)(d).The informant, Stipendiary Steward Mr J Oatham, alleged that Mr R. Norvall permitted his mount APPLETONS LASS to shift inwards near the 150 meters when not sufficiently clear of MIDDAY HERO (A.Peard) which was checked.
Mr Norvall admitted the breach.
FACTS:
Mr Coles demonstrated the video films and pointed out to the Committee APPLETONS LASS, ridden by Mr Norvall shift in a horse width at the 150 metres mark when only a bare length clear. This inner movement resulted in him moving into the running line of MIDDAY HERO (A.Peard) who had to be checked off the heels of APPLETONS LASS.
SUBMISSIONS(s)
Mr Norvall when invited to make submissions said he had dropped his rein half way down the straight and it took a while to gather his mount up again. He admitted he was not aware that Mr Peard was racing directly behind him until he heard him call out. He said he then tried to straighten up his mount but it was too late.
SUBMISSIONS(s) ON PENALTY
Mr Oatham said this was Mr Norvall’s 3rd breach in the last 12 months, both previous breaches resulted in 4 day suspensions. He said the interference was at the low to mid range. He submitted a 4-6 days suspension.
Mr Norvall asked the Committee to consider his good record. He told the Committee he had commitments up to and including 26 June 2010. He acknowledged that he rode only in the North Island.
REASON(s):
The Committee carefully considered all evidence and submissions as presented. The mitigating factor is Mr Norvall’s admission of the breach. However this has to be balanced against the breach itself which resulted in the check to MIDDAY HERO. The Committee believes Mr Norvall’s carelessness was at the low to mid range.
PENALTY:
After taking all the above factors into account we impose suspension on Mr Norvall from race riding to start after racing on 26 June 2010 and to conclude after riding on 3 July 2010 (4 days)
