CHARGES:

Jockey D NOLAN was charged with a breach of Rule 330(3) (c) in that he failed to make the correct weight for JAFA JACK in race 3.  Mr Nolan admitted the breach and appeared before the hearing.

FACTS

Stipendiary Steward Mr Williamson told the Committee that Mr Nolan was due to ride horse 6 JAFA JACK.  When he went to scales to weigh out for the ride he was one kilogram overweight and the Stewards subsequently replaced him for the ride.  The horse subsequently won the race.

SUBMISSIONS ON PENALTY

Mr Williamson sought a fine of between $100 and $200 as this was Mr Nolan’s first breach after having recently arrived in the country.

Mr Nolan said the breach was entirely his fault and apologised.  He had no objection to the penalty sought.

REASONS

The committee took into account the circumstances of the breach, the JCA guidelines and recognised this was Mr Nolan’s first breach in NZ.

PENALTY

Mr Nolan was fined $150.00
