CHARGES:
Following Race 7 an Information was filed pursuant to rule 638 (1) (d). The Informant, Mr M Williamson alleged that VONITSU (R Eynon) allowed his mount to shift in near the 1700 metres when not clear of BIGISGOOD (N Hanley) who clipped a heel losing ground. Mr Eynon admitted the breach.
FACTS:
Mr Robinson demonstrated the video films which showed VONITSU move in and take the line of BIGISGOOD (N Hanley) when only a bare length clear. This caused BIGISGOOD to clip heels and lose ground as a result.
Mr Eynon had nothing to say when asked.
SUBMISSIONS ON PENALTY:
Mr Williamson told the Committee that Mr Eynon had not incurred any charges in the last 12 months. He said this was a case of misjudgment on Mr Eynon’s part when crossing but he should have been more aware of BIGISGOOD on his inside. He submitted this was at the lower end of carelessness.
Mr Eynon told the Committee he had confirmed rides on 10 July 2010.
REASON(s):
The Committee considered the evidence and submissions before imposing an appropriate penalty. Mitigating factors are Mr Eynon’s guilty plea and his excellent record. We are of the opinion that Mr Eynon’s level of carelessness was at the low end as he had moved in slightly on the point of the turn misjudging the distance between his mount and BIGISGOOD.
PENALTY:
Taking all the above factors into account we impose a suspension on Mr Eynon from riding in races which is to start after racing on 10 July 2010 and conclude after racing on 18 July 2010- (4 days).
