CHARGE:

Failing to affix removable earhood so as not to malfunction       

FACTS:

Mr McKendry is the trainer of SACCHA MAGUIRE.  The horse was wearing a removable earhood.  Mr McKendry tried on two occasions in the home straight to remove the earhood but was unsuccessful.  The horse was a close third.

SUBMISSION(s) ON PENALTY:

Mr Taumanu submitted that a fine of $200 should be imposed. 

Mr McKendry did not wish to be present at the hearing.

REASON(s):

The recommended starting point for penalty is a fine of $250. Mr McKendry has no previous breaches of this rule recorded against him.

The submission of Mr Taumanu and other penalties imposed for a breach of this rule have been taken into account as has the admission of Mr McKendry.

PENALTY:

$200 Fine.
