FACTS:
Following Race 4 an Information was filed pursuant to Rule 638 (3b). The Informant, Mr Coles alleged that Miss Collett used her whip in an excessive manner in Race 4.
Miss Collett admitted the breach.
Mr Williamson demonstrated the video films which clearly showed Miss Collett striking her mount 18 – 20 times prior to the 200 metres.
Miss Collett, in admitting the breach, said her mount was lazy and she was just trying to get the best from it.
SUBMISSION(s) ON PENALTY:
Mr Coles said this was Miss Collett’s first whip charge and she had been totally honest with the Stewards. He submitted a fine of $200 - $250 would be appropriate.
Miss Collett had nothing further to add regarding the penalty.
REASON(s):
The Committee considered all evidence before imposing an appropriate penalty. Because this is Miss Collett’s first charge under this rule and she has admitted the breach we determine that the penalty be at the lower end.
PENALTY:
Accordingly we impose a fine of $200.
