CHARGES:
This was a protest by Mr Allison against horse number 9, HEZA BRITESPARK, placed 4th by the Judge on the ground that with 450 metres to run the horse broke and failed to promptly regain its correct gait.
FACTS: Judges placings were:
1st 5, TORASION;
2nd 4, SKYS THE LIMIT;
3rd 1, HONEY PIE;
4th 9, HEZA BRITESPARK;
5th 7, MUM BEAT LYALL.
Mr Allison demonstrated on the video that HEZA BRITESPARK broke around the 450 metres mark and continued in a gallop for a distance in excess of 150 metres.
Mr Russell agreed that the horse had galloped for this distance.
DECISION: HEZA BRITESPARK has galloped for some 150 to 160 metres. In these circumstances the horse has clearly failed to regain its gait promptly and is thus in breach of R 870(3). The horse has gained an advantage over the rest of the field. In these circumstances disqualification is appropriate.
The protest is upheld. Amended placings are:
1st 5, TORASION;
2nd 4, SKYS THE LIMIT;
3rd 1, HONEY PIE;
4th 7, MUM BEAT LYALL.
