CHARGES:

A protest was lodged by Stipendiary Steward Mrs K Williams alleging that the 3^rd placed horse by the judge Jayee’s Magic (Mr M P Jones) caused interference to Lady Gaga (Mr B Barclay) when racing into the first bend causing Lady Gaga to break and lose its chance.

Mr M Jones represented the connection of Jayee’s Magic at the protest hearing .

FACTS/SUBMISSIONS:

Mrs Williams used several video clips of the alleged incident highlighting the inward movement of Jayee’s Magic (M Jones) when racing into the first bend.  Mrs Williams said that Lady Gaga (B Barclay) was drawn number one and was entitled to be racing in that position and that Mr Jones should have allowed Mr Barclay room. By moving inwards Mr Barclay had run out of room causing his horse Lady Gaga to break which in turn interfered with Silky Armbro (B Orange) who also broke and finished in last place.

Mr Barclay (Lady Gaga) stated that he simply ran out of room and that in his opinion his horse did not contribute to the incident in any way and simply the inwards movement by Jayee’s Magic had caused his horse to break.

DECISION:

The committee was satisfied after viewing the video clips of the alleged incident and hearing the statement from Mr Barclay that it was clear that Jayee’s Magic driven by Mr Jones had moved inwards onto Lady Gaga (Mr Barclay) leaving this horse with no racing room and eventually causing it to break.  The committee was of the opinion that no other horse or driver contributed to the incident.

The committee upheld the protest and relegated Jayee’s Magic from 3^rd placing to 9^th placing.
