CHARGES:

Mr B D McLellan was charged under rule 849 (2) in that he presented HABANA with the incorrect saddle cloth. Mr McLellan admitted the breach and did not wish to be present at the hearing.

FACTS:

Mrs Williams stated that the incident could have been far worse had the horse HABANA raced in the incorrect saddlecloth and it was fortunate that it was picked up prior to the race start in the parade area.

DECISION:

The committee was satisfied a breach of the rule had occurred.

SUBMISSION(s) ON PENALTY:

Mrs Williams recommended a fine of $150 be imposed as per the Harness Racing New Zealand guidelines.

PENALTY:

Mr McLellan was fined the sum of $150.
