Plea:  Admitted

 

FACTS:

At the conclusion of Race 1, The Brylin Boyz Trot, an information (67440) was lodged by Stipendiary Steward Mr P T Knowles alleging that Mr A W Kyle (DAWNS BOY) allowed his horse to shift inwards causing interference to KELLY EVANDER which broke.

 

Mr Kyle was present and admitted the breach; we therefore find the charge proven.

 

Rule 869 (3) (b) reads: No horseman in any race shall drive

                                       (b) carelessly

 

Mr Knowles highlighted the incident by showing the Committee a video clip pointing out that with approximately 1500 metres to run Mr Kyle, when improving four wide with DAWNS BOY, moves in on the bend, with his left wheel coming into contact with the hind leg of KELLY EVANDER (B O’Connor) running in the three wide lane inside DAWNS BAY.  KELLY EVANDER broke and lost all chance as a result.

 

Mr Knowles maintained that it is the responsibility of a horseman, when improving, to keep out and in this case Mr Kyle has not done enough.

 

Mr Kyle stated that he had tried to keep his horse DAWNS BOY off KELLY EVANDER, which the Committee accepts, however this was clearly not enough to avoid making contact.

 

Mr Knowles submitted that this matter could be dealt with by way of a fine.  Mr Kyle has no previous breaches of this Rule over a long period of race day driving.

 

PENALTY:

Mr Kyle was fined the sum of $200.00
