Facts:
Mr. J. Parkes admitted a breach of the rule 638 (3) (b). He confirmed his understanding of the rule and the guidelines pertaining to the rule. As the charge was admitted, submissions on penalty were called for.
Submissions:
Mr. Neal showed the video of the incident pointing out to the committee that prior to the 200 metre mark, Mr. Parkes struck his mount 11 times over approximately 75 metres, well outside the guidelines. He was concerned that this was Mr. Parkes' second appearance on this charge in a very short space of time. He was charged and fined $400 last Saturday at Trentham.
Mr. Neal confirmed the incident did not look good and believed this breach should be answered by way of a period of suspension of 3 days.
Mr. Parkes had no comment on the incident but did indicate that as he was a North Island rider only - a point confirmed by Mr. Neal. He wished any period of suspension imposed should begin after racing this coming Saturday 24/07/2010.
Reasons:
Mr. Parkes, in coming to our decision to impose a period of suspension for this breach, we have taken into account your admittance of the breach. We are concerned that you have appeared on this charge again so quickly. You indicated last Saturday that you had a rush of blood to the head and yet today you had no comment. Incidents like this do look bad and the guidelines are put in place to ensure protection for all parties.
We considered the submission of Mr. Neal and the fact that you are considered a North Island rider only. The upcoming race dates for racing in the Central Districts are relatively light this time of the year and we are of the opinion that because of your breach of the rule again in such a short period of time and the seriousness, the period of suspension must reflect that.
Penalty:
Mr. Parkes, you are suspended from race riding from the completion of racing on Saturday the 24th July until the completion of racing on Saturday the 31st of July - 4 North Island days.
