Facts:
Mr. I. Lupton, rider of ‘Starzeen’, admitted that in passing the 700 metre mark he allowed his mount to shift in when not clear of ‘The Rooster’ (C. Perrett) which was checked.
Submission:
Confirming he admitted the breach, Mr. Lupton was taken through the incident on video by Stipendiary Steward Goodwin who informed the committee that in pushing his mount forward looking for a position on the rail he caused ‘The Rooster’ (C. Perrett) to be checked. It was acknowledged by the stewards that there was initially some pressure from the horse on the outside, ‘Henry Daniel’ (G. Walsh) but the pressure was quickly relieved when Mr. Walsh eased off.
Mr. Lupton confirmed that there was for a few strides pressure from the horse on his outside but that he did move across to the rail when not sufficiently clear.
Submission on Penalty:
Mr. Davidson informed the committee that Mr. Lupton was last suspended under this rule on the 11/07/10 for which he received a 5 day suspension. He believed in this case there are some mitigating circumstances as expressed in the submission. He felt it was in the mid to low range and considering the small number of race days in which jumping and high weight jockeys have left this season, he felt a period of suspension of between 2 – 3 days would be appropriate.
Mr. Lupton confirmed he did ride throughout New Zealand and hoped he would be available to take mounts on the jumping day at Trentham on the 26th of September.
Reasons:
In coming to our decision to impose a penalty of suspension, we have taken into account Mr. Lupton’s guilty plea, his record which we believed was very good and the confirmation that there were mitigating circumstances which we should consider. We were mindful of the small number of days available left to jockeys like Mr. Lupton and his desire to ride on jumps day at Wellington.
Penalty:
Mr. Lupton, this committee has decided to suspend you from race riding after the completion of racing on Wednesday the 15th of September 2010 until the completion of racing on Thursday the 23rd of September 2010 (3 days).
