At the conclusion of Race 5, The Harry Pay Discretionary Handicap Trot, a protest was lodged by Stipendiary Steward Mr C J Allison against the second placed horse by the judge, ALENA (N Williamson), alleging that with approximately 100 metres to run ALENA broke and failed to regain its correct gait.
Placings were:
1 No 8 KAWARAU KING – Driver K Barclay
2 No 1 ALENA – Driver N Williamson
3 No 12 BOYZ SUCCESS – Driver A Armour
4 No 4 GO THE BOYZ – Driver C Hanna
5 No 9 SUMMA SONG – Driver C Buchan
The Rule 870 (3) and (4) (a) reads:
(3) Any horse which breaks from its gait shall promptly regain its proper gait.
(4) (a) Any horse which breaks from its gait in any race and which fails to properly regain its proper gait may be placed by the Judicial Committee immediately after any horse in respect of which any advantage may have been gained.
Mr Crackett, the trainer of ALENA, was present at the hearing and did not contest the protest brought by the Stipendiary Stewards.
Stipendiary Steward Mr P T Knowles showed the Committee several video clips of the alleged incident, highlighting the 100 metres marker point prior to the winning post, and the point about 95 metres from the winning post when ALENA broke, never regaining its gait.
The Committee was satisfied a breach of the Rule had occurred and disqualified the second placed horse ALENA, promoting BOYZ SUCCESS (A Armour) to second placing, GO THE BOYZ (C Hanna) promoted to third placing and SUMMA SONG promoted to fourth placing.
