This is an information filed by Stipendiary Steward Mr B. Van Kan against A. and L. Neal trainers of ATTENTION SEEKER alleging a breach of the above rule in that they failed to affix the centre connecting strap so as not to come adrift.
Mr Neal on behalf of the defendants admitted the breach and was present at the hearing.
Mr Van Kan said the Stipendiary Stewards noticed that the strap had come undone about 1200m from the finish of the race.
Mr Neal said the strap came undone just after the start. He said it didn’t affect the performance of the horse and he referred to similar problems with gear being experienced by other trainers in both the North Island and the South Island.
Penalty:
Mr Van Kan recommended a fine of $200.00.
Mr Neal did not make submissions on penalty. He has no relevant breaches of the rules recorded against him.
The recommended starting point for penalty is a fine of $250.00. Penalties recently imposed range from $200.00 to $250.00. Given Mr Neal’s clear record and the fact that the performance of the horse was not affected, a fine of $200.00 is imposed.
