FACTS:
After Race 1 an Information instigating a protest was lodged by Stipendiary Steward Mr J W MUIRHEAD. This protest was on behalf of horse 11 GREGAN GALLEON (A DONNELLY) placed 4th by the Judge against horse 2 ALEKS DREAM (C WILSON) placed 3rd by the judge, on the grounds of interference which was alleged to have occurred with approx 1300 metres to run.
Miss Donnelly appeared for the connections of Gregan Galleon and Mr Wilson and the owner/trainer Mr Goryl appeared for Aleks Dream
Stipendiary Steward Mr Muirhead referred to video footage of the relevant stage of the race and identified the two horses concerned with Aleks Dream trailing Gregan Galleon, when near the 1300 metre mark the left wheel of Gregan Galleon’s sulky was struck by Aleks Dream causing the tyre to flatten and the tube to protrude.
Miss Donnelly confirmed her wheel was struck she thought twice in quick succession. It immediately went flat the tube came out and she finished the race dragging the left wheel.
Mr Wilson felt he was further out and that Miss Donnelly had come out on him in breach of the push out rule but on looking at the tape he admitted any movement was marginal. Mr Goryl said that it appeared to him that Miss Donnelly had moved out a fraction into the feet of Aleks Dream.
Stipendiary Steward Mr T TAUMANU was on patrol and reported the incident after hearing the sulky being struck twice. He felt that if there was any movement from Miss Donnelly it was minimal and it still did not allow the trailing horse to strike the wheel as had been done twice without reason. This cost Miss Donnelly her chance in the race.
DECISION
Having viewed the relevant footage of the incident and having heard from all parties the Committee is satisfied that Gregan Galleon received interference from Aleks Dream near the 1300 metre mark.
This interference affected Gregan Galleon’s chance in the race through the tyre being flattened and the tube coming adrift and the remainder of the race being run with that tyre being dragged.
The Protest is accordingly upheld
In accordance with Rule 869 (8) ALEKS DREAM is relegated to fourth place and GREGAN GALLEON is promoted to third place
The Judges placings are therefore amended as follows

3rd Horse 11 GREGAN GALLEON
4th Horse 2 ALEKS DREAM
5th Horse 1 MAGIC WOMAN
