FACTS:

Stipendiary Steward Mr J MUIRHEAD lodged and information charging horseman G ROBB drove COURTNEY CASS over the track markers in the run home in race 5 in breach of Rule 869(7A)(a)(b)

Mr ROBB admitted the charge and did not wish to appear for the hearing.  The charge was accordingly proven.

Film of the closing stages of the race were shown to the hearing in which it could be clearly seen that Mr Robb had driven  into and over track markers near the end of the race.

SUBMISSIONS ON PENALTY:

Stipendiary Steward Mr T TAUMANU submitted that a fine in the region of  between $100 and $200 was appropriate.

Mr ROBB  had no submissions on penalty.

REASONS:

Having regard to the circumstances, Mr Robb’s driving record, his admission and the recommended guidelines on penalty the committee agreed that a fine of $150 was appropriate.

PENALTY:

A fine of $150 is ordered.
