Following the running of Race 9, the Lawnmaster Awapuni Gold Cup, Ms S. Collett was charged with a breach of Rule 638 (2) in that she made a celebratory gesture prior to the winning post.

Ms. Collett admitted the breach.

Mr. George showed the final stages of the race where Ms Collett quite clearly waved her whip well before the finish post. He said that she had been fined $200 for an earlier breach of the same rule on the 14^th November 2009.

Ms Collett confirmed her record and said that the earlier charge had also been on SIR SLICK.

Decision

In coming to a decision on penalty the committee considered all of the submissions. We took into account the fact that this was a Group 2 race, Ms Collett’s record (being her 2^nd such charge) and her admission of the breach.

She was fined the sum of $350.00.
