CHARGES:
Following Race 1 an Information was filed pursuant to Rule 330(3c). The Informant, Mr Oatham alleged that Mr Ihaka failed to make the carded weight for VICTOR LUDORUM. Mr Ihaka admitted the breach.
FACTS:
Mr Oatham explained to the Committee that Mr Ihaka arrived at the races and was found to be 2 kgs over weight for his mount in Race 1. Unfortunately there was not a suitable replacement rider available so Mr Ihaka was permitted to take the mount.
REASON(s):
Mr Ihaka did not wish to say anything and offered no excuses when asked.
SUBMISSION(s) ON PENALTY:
Mr Oatham said that Mr Ihaka had incurred a charge under this rule as recently as 24 March 2010 and was fined $250. However, he said in Mr Ihaka’s favour, he had contacted Mrs Brown; trainer of VICTOR LUDORUM, at 8.30 this morning informing her he would be overweight. Mr Oatham submitted a fine similar to the previous one would be appropriate.
REASON(s):
The Committee considered all evidence before imposing an appropriate penalty. In mitigation Mr Ihaka admitted the breach and contacted Mrs Brown as soon as he discovered he was going to be overweight. However the aggravating factor is that this is Mr Ihaka’s second charge under this rule in the last 5 weeks.
PENALTY:
Accordingly the Committee imposes a fine of $275.
The Committee explained to Mr Ihaka that his actions today were unacceptable and irresponsible. He was told that in future he must be sure of making the carded weight before accepting rides.
