FACTS:
Following the running of Race 4, www.graemebickley.com Handicap Pace, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Holder of Licence to Train, Mr L R Smart, alleging a breach of Rule 864 (2) (d) in that Mr Smart, as the trainer of FAWN LAKE in the race “failed to affix the offside rein so as not to come adrift”.
Mr Smart had signed the Statement by the Defendant on the information form indicating, firstly, that the breach was admitted and, secondly, that that he did not wish to be present at the hearing of the information.
Rule 864 provides as follows:
(2) Every horseman, owner, trainer and assistant thereof shall with regard to that horse ensure that:-
(d) all gear is correctly applied and/or affixed so as not to malfunction or come
adrift.
SUBMISSIONS:
Mr Escott showed a video replay of the 2600 metres standing start event. FAWN LAKE had led the field early, until taking a trail behind ARJUNA with 1700 metres to run. Shortly after that, the off-side rein on FAWN LAKE became detached. The driver, Mr T M Williams, could be seen to be in difficulty and to be reeling in the loose rein. The horse remained in touch with the pace, but causing trouble to following runners. In the home straight, FAWN LAKE was allowed to drop out and finished a long last. The video evidence was very clear. The Committee also noted that Mr Smart had admitted the breach.
DECISION:
The charge was found proved.
PENALTY SUBMISSIONS:
Mr Escott submitted that a fine of $200 was appropriate.
PENALTY DECISION:
Mr Smart was fined the sum of $200.
