CHARGES: Mr Davidson alleged that Mr Walters, the rider of OLIVINE, shifted in at the 1200 metre point when not clear causing TYPHOON WARNING to be dictated on to VOODOO VIXEN, who was checked. Also affected in this incident were KING MONTROSE and HIGH SEAS.
Mr Walters admitted the charge, which we thus find proved.
FACTS/ SUBMISSIONS: Mr Davidson described the breach as mid range. We agree. We accept that Mr Walters looked before moving inwards at the 1200 metres and that he saw Mr Bullard, Mr Moseley and Mr Bishop checking their mounts. However, he failed to see Ms Van Der Werf who was pressing forward immediately on his inner. As a consequence, Mr Walters moved into her line when at best ¾ of a length clear of her. The result was crowding and Ms Van Der Werf squeezing up the horses on her inner.
Mr Davidson has asked for a 2 to 3 day suspension. Mr Walters does not disagree.
REASONS: Mr Walters’ record is excellent. He has been in the room only once in his 2 year career and that was after his third ride, when he was suspended for 4 days for careless riding. He has had 150 rides since. This fact, plus his ready admission of the breach leads us to conclude that he can be held accountable for his actions by a suspension of 3 South Island days.
PENALTY: Mr Walters is suspended from riding at the conclusion of the meeting here at Oamaru on Sunday 1 August up to and including 14 August 2010.
