CHARGES:

Following the running of race 1, information 65020 was filed by Stipendiary Steward Mr N Goodwin against Mr R Stam alleging a breach of rule 330(c).  The information stated that “Ronald Stam failed to make the weight for Faro Rubino in R1”.

 

Rule 330 (3) (c) states “A rider shall not…..fail to ride a horse at the weight at which it is handicapped to carry…..”

 

Mr Stam indicated the breach of the rule was admitted and also that he understood the charge and the rule it was laid under.

 

FACTS:

Mr Goodwin said when weighing out Mr Stam was found to be 2 kgs over the contracted weight of 53.5kg for Faro Rubino in race 1.  As a consequence he had been replaced as the rider of that horse.

 

Mr Stam said he had weighed himself on his home scales in the morning and thought he was going to be able to ride at 53.5kgs.  On weighing out he was shocked to find he was so much over his contracted weight.

 

SUBMISSIONS ON PENALTY:

Mr Goodwin said Mr Stam did not ride regularly and had only limited opportunities on race day.  He had not been charged under this rule in the last 12 months but 2 kgs overweight was excessive.  He submitted a fine in the region of $150 was an appropriate penalty.

 

Mr Stam was invited to make his submissions on penalty but had no comments to make other than he was sorry for what had happened.

 

REASONS:

In coming to a decision on penalty the Committee Has considered Mr Stam’s admission of the breach and the fact he has not breached this rule in the previous 12 months.  However, being 2 kgs overweight and the late advice to the stewards is unacceptable. 

 

PENALTY:

The Committee has decided a fine is appropriate in this case and Mr Stam is fined $150.
