CHARGES:
Following race 8 an information was filed pursuant to rule 610 (4). The informant Mr Coles alleged that Mr Holmes used and had in his possession a modified body protector.
FACTS:
Mr Coles told the committee that Mr Williamson had inspected the vest belonging to Mr Holmes prior to race 8. The vest was found to be lacking the amount of protective padding that a vest of this type should normally have.
SUBMISSION(s):
Mr Holmes explained to the committee that this was his only race day vest and he had purchased it from a friend in Australia. He said he had worn it consistently for the last 2 years in New Zealand, Australia and Macau.
SUBMISSION(s) ON PENALTY:
Mr Coles said that this was Mr Holmes’ first offence under this rule but past breaches similar to this one had resulted in fines of $500 which he believed was appropriate in this case.
Mr Holmes had nothing to add.
REASON(s):
The committee considered all evidence as presented and before imposing an appropriate penalty took into account Mr Holmes’ guilty plea and that this was his first charge under this rule.
PENALTY:
In the interests of consistency which we believe is imperative to maintain in a charge such as this we impose a fine of $500.
