CHARGES:

Following Race 3 an Information was filed pursuant to rule 638 (3) (b).  The Informant Mr Williamson alleged that Mr S Doyle, rider of WAITOKI AHI, used the whip in an excessive manner.

 

FACTS:

Mr Oatham demonstrated the video films which showed Mr Doyle striking his mount excessively without giving the required respite.  Mr Oatham said Mr Doyle did give some respite but certainly not for the required 6 strides. 

 

SUBMISSION(s):

Mr Doyle had nothing to say.

 

SUBMISSION(s) ON PENALTY:

Mr Williamson said this was Mr Doyle’s first charge under the whip rule and submitted his carelessness was at the low end. 

 

Mr Doyle had no submissions to make.

 

REASON(s):

The Committee considered all evidence and submissions before imposing an appropriate penalty.  Mitigating factors include Mr Doyle’s guilty plea and that this was his first charge under the whip rule.  However it was clearly evident he did use the whip in a manner contrary to the guidelines set down.

 

PENALTY:

Accordingly after taking all the above factors into account we fine him the sum of $150.
