Careless riding

This charge arises from the running of Race 4, A Maiden 1200m event. Stipendiary Steward, Mr Coles filed an Information pursuant to Rule 638(1)(d) alleging the Rider of GREY WOLF (G Grylls),” allowed his mount to shift in near the 900 metres when not sufficiently clear of AURORA STAR which was dictated in crowding STREET CAT and SHOW ‘N’ TEASE which were checked”.

Mr Grylls acknowledged he understood the Rule and confirmed his admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Using the available race films Ms Selvakumuran demonstrated the incident and identified the horses and Riders concerned; GREY WOLF (G Grylls), AURORA STAR (V Colgan), STREET CAT (E McCall) and SHOW ‘N’ TEASE (L Satherley).

Ms Selvakumaran said that at around the 900m Mr Grylls looked to his inside and commenced to shift towards the rail and identified that to his inside and a bare length behind was the runner AURORA STAR. During this shift AURORA STAR was placed in restricted room and commenced to over race, becoming unbalanced and resulting in checks to STREET CAT and SHOW ‘N’ TEASE.

Mr Grylls said that he was riding his mount forward to clear the inside runners and move towards the rail. He said that Mr Colgan’s mount was racing fiercely inside and just behind him but wasn’t aware of this at the time and thought he was being as careful as possible. Upon viewing the video Mr Grylls conceded that he wasn’t his own length and another length clear.

As Mr Grylls admitted the breach the Committee found the charge proved.

Submission For Penalty:

Mr Coles produced Mr Grylls' riding record which indicated 2 previous breaches under the Careless Riding Rule in the last 12 months and Mr Grylls was a very busy Rider. He said that the Stipendiary Stewards put the level of carelessness at the mid-range, but said there was mitigation due to Mr Colgan's mount racing ungenerously, prior to becoming unbalanced.

In response Mr Grylls said that he had a very good record and that he had riding commitments for the next 10 days, requesting that any proposed suspension start after the 3rd of July.

Reasons For Penalty:

After considering the submissions and reviewing the race film the Committee determined Mr Grylls' carelessness to be mid-range and adopted a 5-day (suspension) and $500 (fine) as the starting point.

The Committee viewed the head-on, side-on and back-on films which established that Mr Grylls did shift in when not sufficiently clear of the trailing runners.

Mr Grylls' riding record was assessed as being very good, and this combined with admission of the breach and the small amount of mitigation due to the over racing of the surrounding runners, afforded Mr Grylls a 1 day reduction from the starting point.

The Committee granted Mr Grylls a deferment to his suspension pursuant to Rule 1106(2). Accordingly, his licence to ride in races is suspended for a period of 4 days commencing after racing on the 3rd July 2021 and concluding after racing on 10th July 2021. In addition, we impose a $500 fine.
