CHARGES:
Following Race 3 an Information was filed pursuant to Rule 638(3b). The Informant Mr Williamson alleged that Mr Hanley used the whip in an excessive manner on his mount MACASTAR.
Mr Hanley admitted the breach.
FACTS:
Mr Coles demonstrated the video films which showed MACASTAR, the favourite, racing well back in the field at the 600 metre mark. Mr Coles said from this point until the 200 metres, Mr Hanley struck his mount approximately 16 times without the required respite. He said Mr Hanley gained an unfair advantage through his excessive use of the whip.
Mr Hanley said he understood the guidelines but in this case he did not believe his use of the whip was excessive. He said his mount was sluggish all the way and being the favourite he needed to apply more pressure.
SUBMISSION(s) ON PENALTY:
Mr Williamson said Mr Hanley had never been spoken to regarding his use of the whip. However in this case Mr Hanley had not given his mount the necessary reprieve after 6 strikes with the whip. He submitted a fine of $150 - $250 would be appropriate.
Mr Hanley had nothing further to say.
REASON(s):
The committee considered all evidence as presented. Mr Hanley’s guilty plea and that this was his first whip charge are in his favour. Also to be taken into account is that Mr Hanley was riding the favourite and it responded to the whip by finishing on for 4th. However it was clear to the Committee that Mr Hanley did exceed the whip guidelines by striking his mount approximately 16 times without the necessary reprieve.
PENALTY:
After taking the above facts into account we impose a fine of $150.
