DECISION AND REASONS:
Following the running of Race 11, the Denniston Dog Café & Bar (Westport) Trot, an information was filed by Chief Stipendiary Steward Mr N. R. Escott alleging a breach of the “lapped on” rule, Rule 870(5), by “Seeker Dhu” (15) trained and driven by Mr B. Weaver.
Mr Weaver did not attend the hearing, but he had endorsed the Information “I do not contest the relegation of Seeker Dhu”.
Mr Escott provided evidence that “Seeker Dhu” had broken from its gait over the final stages, and was still in a break when it crossed the finishing line, at which time it was in 4th place. At that time it was lapped on by the 5th, 6th and 7th placed horses. Mr Escott sought relegation of “Seeker Dhu” to 7th place.
Accordingly “Seeker Dhu” was relegated to 7th place. The amended places are as follows.
1st – Proud Monarch (6)
2nd – Cheval De Triomphe (8)
3rd – Ugly Betty (9)
4th – Tehoro Grace (13)
5th – The Soldier Fritz (10)
6th – Sun Of Mystery (1)
