An information 5539 was lodged by Stipendiary Steward Mr M Davidson under Rule 638 (2) alleging that Mr J Bates, the rider of LAUTENSCHLAGER, made a celebratory gesture prior to the winning post in Race 9, the 101st Carriers Arms Hotel Riverton Cup.
Mr Bates admitted a breach of the Rule and was present at the hearing.
Stipendiary Steward Mr Davidson showed the Committee several video clips of the incident highlighting Mr Bates’ celebratory gesture, about half a horse stride from the winning post. Mr Bates stated that he had not won a Riverton Cup previously and that being born in Riverton and the fact the horse had been set with this race in mind, he was “rapt’ with the win. Another half stride and he would have been “okay”, he told the Committee.
SUBMISSIONS ON PENALTY
Mr Davidson advised the Committee that the Riverton Cup was a Stakes Listed race. He also highlighted to the Committee that the celebratory gesture was very close to the winning post. Mr Davidson also stated that at the Wingatui meeting in March Jockey M was fined $200 under the same Rule in a Stakes Listed race. Mr Davidson recommended a range of penalty between $150 and $250.
PENALTY
The Committee was satisfied a breach of the Rule had occurred and Mr J Bates was fined the sum of $200. In fixing penalty the Committee took into account the status of the Riverton Cup. However, the fact that the gesture was so close to the winning post was a relevant compelling factor in the monetary penalty.
