CHARGE(s):
Permitted his mount BLACK N BLUE to shift inwards near the 1000metres when not sufficiently clear of LISA ANNE ridden by Ms M Wenn which was crowded and then checked.
FACTS:
Stipendiary Steward Mr J Oatham showed and interpreted the video film of the incident. Mr Oatham said SUMMER’S PRIDE ridden by Mr C Grylls crossed in front of LISA ANNE which then over-raced and moved outwards slightly. Mr Jago then moved BLACK N BLUE inwards in front of LISA ANNE but BLACK N BLUE was not sufficiently clear of that horse. Ms Wenn then had to restrain LISA ANNE.
Mr Jago said he had looked inwards before moving BLACK N BLUE inwards but he did not see LISA ANNE.
SUBMISSION(s) ON PENALTY:
Mr Williamson said that Mr Jago had no breaches of the rules recorded against him in the last 12 months, the offending was in the lower half of the scale of seriousness and he submitted that a suspension at the lower end of the scale was appropriate.
Mr Jago accepted the submissions of Mr Williamson.
REASON(s):
In fixing penalty the committee takes into account the admission of the breach, the submissions of Mr. Williamson and the acceptance of them by Mr Jago, the excellent riding record of Mr Jago and agrees the offending is at the lower end of the scale.
PENALTY:
Balancing the above matters but with emphasis on the relative non seriousness of the breach and Mr Jago’s excellent riding record, Mr Jago’s riders licence is suspended for four days, commencing at the end of racing on 16th September and concluding at the end of racing on the 23rd September 2010.
