Plea: Admits the breach
Following the running of race four “The Cotec Paint @ The Decorator Centre 1200.”Mr Goodwin lodged a information alleging Ms Myers near the 250 metres permitted her mount “Kaap Kruis” to shift out into the line of running of “Mi Payday” crowding that runner out onto “Sherborne” resulting in both “Mi Payday” ridden by C Grylls and “Sherborne” D Walker being checked.
Rule 638(1) A rider shall not ride in a manner which the Judicial Committee considers to be (d) careless; was read and Ms Myers confirmed she understood the rule and did admit the breach.
Mr Goodwin presented his case by showing the head on and side on films where R Myers was on the inside rail full of running when she pulled her mount Kaap Kruis out into the line of Mi Payday. While attempting to take a gap her mount has overreacted and made contact with Mi Payday who was quiet severely buffeted who has gone out onto Sherborne, resulting in both horses being inconvenienced for several strides. Mr Goodwin said there was a gap there to be taken but unfortunately Kaap Kruis has over cooked it a little, moving out a half horse width too much and caused the tightening to the other runners.
Ms Myers said her mount had over reacted and has come out more than she had expected.
Ms Myers did admit the breach and the Committee confirm the charge proven.
Penalty
Mr Goodwin in giving Ms Myers penalty record of three suspensions this year being
19/11/09-4days; 7/1/10-4days; 4/2/10-5days; commented that R Myers is a national rider and this penalty was in the low to medium range, but with Ms Myers record believes a penalty in the region of five days suspension to be appropriate.
Ms Myers asked the committee to consider a suspension to start after Saturday 3rd April.
Decision
The committee considered all submissions before imposing a penalty and took into account;
1 Ms Myers did admit the breach.
2 The level of carelessness at low to medium.
3 Ms Myers previous record of three charges this year.
4 Two horses’ chances were affected.
The committee impose a term of suspension from the close of racing on Saturday 3rd April up to and including Saturday 10th April 2010 - 5days.
