CHARGES:
Following race 9 an information was lodged under rule 638 (3) (b) a rider shall not strike a horse with a whip in a manner or to an extent which is unnecessary, excessive or improper. In that K Collins used the whip excessively on his mount Goldmist.
FACTS:
Mr Oatham demonstrated on the video films, front, head and side on where between the 400m and the 200m Mr Collins has continued to use the whip with only one short break with an estimation of 14 to 16 strikes.
SUBMISSIONS:
Mr Collins had nothing to add.
The charge is proven.
SUBMISSION(s) ON PENALTY:
Mr Oatham stated that K Collins has no previous charge under this rule. It is clearly not the worst offence and the stewards regard it at the lowest end of the scale and seek a penalty by way of a fine in the range of $150 to $200.
Mr Collins stated due to the heavy track he was trying to give the horse and its owners every chance. Mr Collins had nothing to add in regard to the penalty.
REASON(s):
In reaching a decision on penalty the committee has taken into account the early admission to the charge, Mr Collins very good record, and the degree of seriousness being at the lower end. It is clear that he did use the whip outside the guidelines set down.
PENALTY:
The committee imposes a penalty by way of a fine of $150.
