CHARGE(s):   

D Hain, being the rider of PLATINUM GIRL, placed 5th, failed to ride his mount out fully in the final 75metres when there was a reasonable chance of the horse finishing in a higher placing.

 

FACTS:           

Stipendiary Steward Mr M Williamson showed and interpreted the film of the incident. Mr Hain sat up about 75metres from the finish.  He started riding out his horse about 2 strides from the winning post when he realised he was being overtaken by ROYAL ROSE ridden by Ms M Vance.  ROYAL ROSE was placed 4th a short neck ahead of PLATINUM GIRL.  Mr Hain said it was the first time he had made an error of this nature.   

                                                  

SUBMISSION(s) ON PENALTY:    

Mr Oatham said Mr Hain had no previous breaches of this rule and had a good riding record in the last 12months.  He said Mr Hain had been honest and up front and the offending was mid range on the scale of seriousness.  He said PLATINUM GIRL lost momentum in the testing conditions when Mr Hain stopped riding.  He submitted a 2 week suspension was appropriate.

 

Mr Hain accepted the submissions of Mr Oatham.

                                                     

REASON(s):   

The committee takes into account the admission of Mr Hain, the submissions of Mr Oatham and Mr Hain’s acceptance of them, Mr Hain’s clear riding record and other penalties imposed for a breach of this rule.  The committee agrees that the offending was “mid range”.

                         

PENALTY:    

Balancing the above matters Mr Hain’s jockeys licence is suspended for 2 weeks commencing at the end of racing on 30th June and concluding at the end of racing on the 14th July - this allows Mr Hain to fulfill current engagements.
