CHARGE(s):    

Mr Ormsby, being the rider of FIXINTOFLY, made a celebratory gesture prior to passing the winning post.

FACTS:           

Mr Oatham showed the video film of the incident.  Mr Ormsby stood up and waved his whip one stride prior to the winning post.  Mr Ormsby said he was “Over the moon” because he won the race.

SUBMISSION(s) ON PENALTY:    

Mr Oatham said this was the first charge Mr Ormsby had faced – it is his first season with a full licence - he was over excited – the offending was at the lower end of the scale.  He submitted that a fine of $150 was appropriate.  Mr Ormsby accepted the submissions of Mr Oatham.

REASON(s):   

The committee takes into account the admission of the breach, the clear riding record, the submissions of Mr Oatham and the acceptance of them by Mr Ormsby.  The committee agrees the offending is at the bottom end of the scale and takes into account other penalties imposed for a breach of this rule.

PENALTY:

Balancing the above matters a fine of $150 is imposed.
