Following the running of Race 4, Norfolk Motors Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Holder of Licence to Train, Mr W H Dobbs, alleging a breach of Rule 864 (2) (b) in that Mr Dobbs, as the trainer of FIRE OF ROCK in the Race, “presented this horse to race with the front hopple carrier in poor condition”.
Mr Dobbs had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.
Rule 864 provides as follows:
(2) Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse ensure that:-
(b) any gear, appliance or device used or to be used in a race is of good quality and in good order and condition.
Mr Ydgren informed the Committee that the front off-side hopple carrier on FIRE OF ROCK broke during the running and dropped from the horse’s foreleg to below its knee. The horse tripped and broke, losing all chance.
Mr Ydgren said that the gear was inspected following the race and it was found that it was extremely worn on the hole that had broken.
Mr Ydgren recommended a fine of $200
Mr Dobbs was fined the sum of $200.
