CHARGES:

Following race 7 an information was filed pursuant to rule 638 (1) (d).  The informant Mr C George alleged that near the 1200 metres Mr C Grylls (MEGAN’S TOUGHLOVE) allowed his mount to shift in.  This resulted in HINEMOA (H Kasim) being dictated in onto THE PARTY STAND (A Calder) which was hampered and shifted in onto QUE SERA (M Coleman) which in turn was severely check.  FIRELIGHT (T Thornton) which was following these horses was also severely checked as a result.

 

FACTS:

Mr Williamson demonstrated the video films which showed at a point near the 1200 metres MEGAN’S TOUGHLOVE racing in a five off position.  Mr Williamson then pointed out to the committee Mr Grylls begin to shift inwards and into the line of HINEMOA when a bare length clear.  Then this started a concertina effect with THE PARTY STAND, QUE SERA and FIRELIGHT all receiving significant checks. 

 

SUBMISSION(s):

Mr Grylls said he thought he was clear when moving across but obviously the films showed otherwise.

 

SUBMISSION(s) ON PENALTY:

Mr George said this was Mr Grylls second charge in twelve months which was an excellent record.  He said Mr Grylls was also a national rider and submitted a 4 -5 day suspension would be appropriate.

 

Mr Grylls said he had commitments up to and including 27 October.

 

REASON(s):

The committee considered all evidence and submissions.  The mitigating factors in Mr Grylls favour are is admission of the breach and his excellent record.  However the interference received by four horses is also very relevant in our decision.  This was due to Mr Grylls moving in when only a bare length of HINEMOA.  Normally the committee considers this breach would warrant a five day suspension.  However, because of the mitigating factors above, we have reduced this to one of four days.

 

PENALTY:

Accordingly we impose a suspension on Mr Grylls from riding in races which is to start after racing on 27 October and conclude after racing on 31 October 2010 (4 days).
