FACTS:
Mr Davidson sought the disqualification of SCARLETT FEVER from 4th place in race 2 on the ground that the rider of the horse, Mr Chong, had weighed in 0.8 kg light.
Mr Davidson stated that SCARLETT FEVER was allotted 57.5 kg by the handicapper. Mr Chong has a 4 kg allowance. When the 1 kg for the safety vest is added, Mr Chong was required to weigh in at 54.5 kg. In fact he weighed in at 53.7 kg. He was thus 0.8 kg light.
Mr McLaughlin gave evidence that he viewed Mr Chong weigh in at 53.7 kg. Mr Chong confirmed this and explained that he had weighed out with a towel and had left this off when saddling.
SUBMISSION(s):
Mr Davidson submitted that SCARLETT FEVER should be disqualified.
REASON(s):
R 648(3) states:
If, on being weighed in, a Rider cannot draw the proper weight (meaning thereby the weight allotted by the Handicapper for his horse to carry and adjusted only by any rehandicap, by having been declared overweight, by penalty or by authorised allowance) the Clerk of the Scales shall allow such rider 0.5 kg and if the allowance is not sufficient to enable the proper weight to be drawn then subject to sub-Rule (4) of this Rule then in addition to any other penalty which may be imposed the horse shall be disqualified for the Race.
We are satisfied on the evidence before us that Mr Chong has weighed in 0.8 kg below his “proper weight”. The Rule is clear: in these circumstances “the horse shall be disqualified”.
DECISION:
SCARLETT FEVER is disqualified from 4th. Amended placings are: 9, 3, 4, 2, 11.
