CHARGES:
Following race 3 an Information was filed pursuant to Rule 638(1)(d). The informant, Stipendiary Steward Mr M Williamson, alleged that Mr P.Holmes permitted his mount ELIGIBLY to shift inwards near the 900 metres when not sufficiently clear of BYRAIN (S.Spratt) which was checked. Mr Holmes admitted the breach and acknowledged he understood the rule.
FACTS:
Mr Oatham, Stipendiary Steward, demonstrated the video films which clearly showed at the 900 metres Mr Holmes allowed his mount ELIGIBLY to apply pressure inward onto BYRAIN when not the required distance clear, this resulted in Miss Spratt been checked. The head on film showed ELIGIBLY head was turned in at the time of the interference.
SUBMISSIONS(s):
Mr Holmes, when asked, said that BYRAIN ridden by Miss Spratt was over racing which made the interference look worse.
SUBMISSIONS(s) ON PENALTY:
Mr Williamson said Mr Holmes has been riding back in New Zealand for 3 months in which he has a clear record. He submitted a suspension at the lower end.
Mr Holmes when invited to make submissions on penalty said he had commitments up to and including 26 June 2010. He acknowledged that he is currently riding only in the North Island.
REASON(s):
The Committee carefully considered all evidence and submissions as presented. The mitigating factors are Mr Holmes admission of the breach and his clear record. However this has to be balanced against the interference received by Miss Spratt. The Committee believes Mr Holmes has a very good record in the short term back riding in New Zealand and rate the interference at the low end.
PENALTY:
After taking all the above factors into account we impose a suspension on Mr Holmes from race riding to start after racing on 26 June 2010 and to conclude after racing on 3 July 2010. (4 days)
