CHARGES:
Following Race 7 an Information was filed pursuant to rule 638 (1) (d) by the Informant Mr Coles. He alleged that, passing the 1000 metres, T Arumugam, rider of STERLING PRINCE, allowed his mount to shift in when not sufficiently clear of RUSTY DEVIL (L Satherley).
FACTS:
Mr Williamson demonstrated the video films which showed STIRLING PRINCE (T Arumugam) racing in a position 1 ½ horse widths off the rail when approaching the 1000 metres. Racing on his inside was RUSTY DEVIL (L Satherley) who was hard up against the running rail. Soon after passing this point Mr Arumugam allowed his mount to move in towards the rail when not the required distance clear of RUSTY DEVIL. This caused Mrs Satherley to check her mount as Mr Arumugam was only a bare length ahead of her when moving across.
Neither Mr Hillis nor Mr Arumugam had any comments regarding the incident.
SUBMISSION(s) ON PENALTY:
Mr Coles said it was clear that RUSTY DEVIL was checked but did concede that RUSTY DEVIL didn’t help the situation by running erratically. He commented this was not the worst interference by any means and submitted a penalty at the lower end would be appropriate as this was Mr Arumugam’s first charge.
Mr Hillis confirmed to the committee that Mr Arumugam did not have any forthcoming engagements.
REASON(s):
The Committee considered all evidence and submissions before imposing an appropriate penalty. Mitigating factors are Mr Arumugam’s guilty plea, this was his first charge and the contribution to the incident by RUSTY DEVIL. However Mr Arumugam did move in when not the required distance clear which was the main reason RUSTY DEVIL was checked.
PENALTY:
Accordingly after taking all the above facts into account we impose a suspension on Mr Arumugam from riding in races which is to start after racing today 24 July and conclude after racing on 31 July 2010 (4 days)
